The young people who brought this case forward argued that Montana’s policy of evaluating requests for fossil fuel permits violates the state’s constitution since it doesn’t allow the state to measure the effects of greenhouse gas emissions.
The judge affirmed the climate activists' argument, and even went so far as to say:
“Montana's emissions and climate change have been proven to be a substantial factor in causing climate impacts to Montana's environment and harm and injury”
