This week, a former president of the United States was indicted for racketeering—bringing his total criminal charges to a staggering 91 felonies.

Honestly, we should not have to say much more to express the urgency of this moment for our democracy. It can't be a good day when the former president is charged under laws historically used against the mafia. But his conduct demanded it, and as we said in our statement, that makes this indictment a positive step for our country.

But as important as these indictments are, they won't disqualify Trump from holding office—only the Constitution’s 14th Amendment does that. Right now, we’re preparing to enforce Trump’s disqualification and gaining momentum every day. It shows in the news.

This month alone, CREW’s work on the Disqualification Clause was covered in New York Magazine, The Nation, Salon, an MSNBC op-ed, and Common Dreams, with several outlets citing our new comprehensive report detailing the case for Trump’s disqualification. CREW President Noah Bookbinder also appeared on MSNBC’s All In with Chris Hayes to discuss the precedent CREW set for Trump’s disqualification and our planned action to enforce it. And CREW Executive Vice President and Chief Counsel Donald Sherman published an op-ed in The Hill explaining how our work recently got a boost from conservative legal scholars.

Our newest analysis lays out the expert reports that have called the January 6th attack an insurrection—in sharp contrast to Ron DeSantis’s recent comments insisting that it was “not an insurrection,” but rather a protest that “ended up devolving.” We also explained how the charges against 16 Michigan fake electors provide a blueprint for accountability in the six other states with fake electors schemes.

We’ve kept up the pressure to pass Supreme Court ethics reform, too. In partnership with Judge Jeremy Fogel at the Berkeley Judicial Institute, we laid out some steps the Supreme Court can take to regain declining public trust. If people don't trust the Court to be fair and impartial, that’s a major issue for our democracy. CREW Executive Vice President and Chief Counsel Donald Sherman continued to call out Justice Clarence Thomas’s unethical conduct in The Guardian and explained to TheGrio that contrary to Justice Samuel Alito’s claims, Congress can impose ethics rules on the court.
