Today, in a radical decision, the U.S. Court of Appeals for the Fifth Circuit ruled to reinstate burdensome restrictions on the abortion pill mifepristone that could drastically limit abortion access in most states. This ruling will not take effect immediately and medication abortion will remain available under the current regulations while the case proceeds.

This decision sets up a showdown at the U.S. Supreme Court over baseless attacks on medication abortion, which has been a lifeline since the high court reversed Roe v. Wade last year. This order, if allowed to take effect, could jeopardize the U.S. Food and Drug Administration's (FDA) entire scientific system of drug approvals and would leave patients panicked and confused about their health and safety.
More than 5 million Americans have safely used mifepristone since it was approved by the FDA more than 20 years ago, underscoring how frivolous and politically motivated this lawsuit is. The anti-abortion agenda has always been to ban all abortion care across the United States: if allowed to take effect, this ruling brings them one step closer.
Medication abortion accounts for 54% of abortions in the U.S., and limiting access to mifepristone will only worsen the ongoing public health crisis since Roe was overturned—especially for people living in rural areas or parts of the country where the nearest clinic may be hundreds of miles away.
