Professors William Baude and Michael Stokes Paulsen — both members of the very conservative Federalist Society — studied the 14th Amendment of the Constitution, and came to the same conclusion CREW did. They found that Donald Trump is disqualified from office under the 14th Amendment and cannot serve as president.
CREW’s been saying this for months, and as Noah said on MSNBC, we’ve used this legal argument to disqualify an insurrectionist from holding office already. Now, we’re preparing to use the same argument to disqualify Donald Trump. This paper by these legal scholars only strengthens our case.

CREW represented residents of New Mexico who brought a lawsuit to disqualify Couy Griffin – a County Commissioner in New Mexico and founder of “Cowboys for Trump” – from office after he participated in the January 6th insurrection.
We argued that January 6th was an insurrection and that the 14th Amendment disqualified Couy Griffin from holding public office at any level. The court agreed – disqualifying Couy Griffin from office, and immediately removing him from office, using that provision of the 14th Amendment for the first time in 150 years.
Trump is not qualified to be on the ballot for president. The Constitution says he can not serve. The Constitution must be enforced – and CREW is preparing to do just that.
