Idaho lawmakers need to face it – their extreme ban on abortion is unconstitutional.
A federal judge recently shut down the Idaho Attorney General’s latest attempt to criminalize healthcare providers and those who seek reproductive care. This policy would have allowed for prosecution of doctors who refer their patients to other states for abortion.
It’s a clear violation of a doctor's First Amendment rights, and the federal judge hearing the case ruled accordingly.
One thing is clear – not only do Idaho Republicans have no regard for reproductive freedom and the necessity of maternal healthcare, they either don’t understand how to make policy constitutional, or they don’t care.
This court victory is a small win in the midst of a disastrous time for women’s bodily autonomy and access to medical care for all.
Idahoans shouldn’t have to leave our private medical decisions to the discretion of a federal court.
We need lawmakers at all levels of government who care about protecting women’s lives and access to reproductive care for all. We need federal protections for abortion access – and we need it now.
