In striking down Roe v. Wade last June, the Supreme Court ruled that Americans do not have the constitutional right to an abortion. As a result, Republicans are attacking and dismantling reproductive health care state by state.

But it's not all bad news: thanks to the success of Democrats in last year's midterm elections, we were able to protect abortion access for tens of millions of Americans. Now, we're gearing up to do it again in 2023 and 2024.

Here's a breakdown of where abortion laws currently stand across the country:

  1. Abortion is banned or mostly banned in Idaho, North Dakota, South Dakota, Wisconsin, Missouri, Arkansas, Oklahoma, Texas, Louisiana, Kentucky, Tennessee, Mississippi, Alabama, Georgia, Indiana, and West Virginia.

  2. In Arizona, Nebraska, North Carolina, and Florida, abortion is banned after 12 or 15 weeks. (But Florida's governor, Ron DeSantis, signed a six-week abortion ban into law, which is set to take effect soon).

  3. In Utah, Wyoming, Ohio, Iowa, and South Carolina, laws banning abortion have been temporarily blocked by courts.

  4. Abortion is still legal — for now — in Virginia. The only way to ensure the continued legality of abortion in the states is to hold the state Senate and flip the House of Delegates this November, which is why we've endorsed 29 women running in Virginia's state legislative elections.

  5. In the 24 remaining states, abortion is legal and likely to remain protectedif we're able to protect the Senate and take back the House in 2024. Republicans in Congress have made it clear they intend to pass a national abortion ban if they regain power.

The last midterm elections proved that the only way to prevent and reverse abortion bans is to keep anti-choice Republicans out of power at all levels of government. We now know that when choice is on the ballot, choice wins.
