The EATS Act seeks to undo two American elections—Prop 12 in California and Amendment 3. These measures established prohibitions on extreme confinement of some farm animals and also limited in-state sales of pork, eggs, and veal from factory farms. These are fabulous laws, approved in landslide votes by lawmakers.
But some Members of Congress want to wipe them out. They want to unwind states’ rights.
BACKGROUND
Right now, countless pigs on factory farms are immobilized in "gestation crates"—two-foot-by-seven-foot cages that are barely larger than the 400-pound mother pigs' bodies. It's a form of torture to confine breeding sows so severely that they cannot even turn around. That confinement isn't limited to a few minutes or a few hours—pigs are locked in place for up to three years. The poor, trapped animals resort to biting on the metal bars as an expression of their physical and psychological torment.
The National Pork Producers Council (NPPC) and its allies challenged the voter-approved laws in court—and lost over and over again. Their legal maneuvers eventually found their way to the U.S. Supreme Court, and the conservative-dominated justices ruled against the NPPC and for the rights of states to establish animal-welfare and food-safety standards.
Now, the factory farming lobby is demanding that Congress negate American elections and a series of judicial proceedings.
