John, Virginia made history in 2020 when it became the 38th state to ratify the Equal Rights Amendment (ERA), meeting the threshold for Constitutional certification without any further action from Congress. Yet three years later, the ERA has yet to be published in the Constitution as the 28th Amendment. Attacks on our basic rights have only grown since then. State legislators have moved quickly to restrict the right to choose since the Supreme Court overturned Roe v. Wade, as well as deny access to gender-affirming care for members of the LGBTQ+ community. These regressive and dangerous actions can be eliminated and prevented with explicit constitutional language prohibiting discrimination on the basis of sex, which the ERA provides.
