The 14th Amendment to the Constitution, which was ratified in the aftermath of the Civil War, contains a provision that most people have forgotten about in the 150 years since:

Section 3 of the 14th Amendment says that if a person swears an oath to support the Constitution, then engages in insurrection against it, that person is disqualified from office.

What the framers of the 14th Amendment knew is that people who try to overthrow the government and overturn democracy shouldn’t be allowed to lead it.

CREW dug into the historical precedent and found eight examples of people who were formally disqualified under the 14th Amendment, including several Confederate leaders.

That may have been many years ago, but this amendment was truly created for the moment in which we find ourselves. We faced an effort to overturn a free and fair election to keep someone in power who had lost, and to do it violently.

The January 6th insurrection is exactly the kind of event that this part of the 14th Amendment was written to address.

CREW has been methodically setting out what this law says, what the legal precedent is, how it applies to the January 6th insurrection and why Donald Trump specifically is somebody who engaged in insurrection and is disqualified from office.

John, we’ve been building our case for months.

We started by setting legal precedent when we represented New Mexico residents in a legal action that resulted in the disqualification of former County Commissioner Couy Griffin under the 14th Amendment and the judge’s finding that January 6th was an insurrection.

Then we released a report laying out 15 examples of federal judges blaming Trump for the insurrection.

Then we released a report identifying 174 January 6th defendants who said that they went to DC and the Capitol on that day because Trump told them to.

Finally, this month, we released our most comprehensive report yet, putting all of this together (in 90 pages of detailed findings) to make the case that Donald Trump specifically caused the insurrection and is disqualified from ever holding office again.
