Wyoming Department of Environmental Quality Notice of Proposed Classification of Groundwater
Pursuant to Water Quality Division (WQD) Rules and Regulations Chapter 8, the WQD is providing notice for the proposed classification of the groundwater in the production zones as Class V (Mineral Commercial).? This classification includes specified production zones for the Battle Springs Formation HJ and KM Horizons which range in depths from approximately 340 to 675 feet below ground surface.? The groundwater, after mining, shall be returned to a condition and quality consistent with the pre-discharge use suitability of the water.
Lost Creek ISR, 1478 Willer Drive, Casper, WY has applied for an in-situ uranium mining permit from the Land Quality Division (LQD) of the DEQ.? The mining permit area for the mining of uranium will be located in: all or portions of Sections 2, 3, 10, 11, 14, 15,19, 20, 22, and 28 of Township 25 North, Range 92 West; Sweetwater County, Wyoming.? A separate public notice was developed by the LQD for the proposed mining permit and is being filed separately from this notice.
The public comment period begins on July 26,2023, and ends on August 25, 2023.? Electronic copies of the proposed Statement of Basis (SOB) for an Aquifer Exemption and other associated information are available for review.
The SOB (a.k.a. Mining Application Appendix D-12) can also be reviewed along with the mining permit application in the LQD office in the Cheyenne, or the Sweetwater County Clerk?s Office in Rock Springs, Wyoming.
During the 30-day public comment period, any interested person may submit written comments on the proposed permit and may request a public hearing be held.? Electronic comments may only be submitted through and accepted by the WDEQ comment portal provided at [link removed] [ [link removed] ].
Requests for public hearings on permit applications or modifications must be made in writing to the administrator and shall state the reasons for the request.? Requests for public hearings on permit issuance, denial, revocation, termination, or any other department action appealable to the Council, shall be made in writing to the Chairman of the Environmental Quality Council (Chairman, Wyoming Environmental Quality Council, 2300 Capitol Ave., Hathaway Bldg. 1st, Room 136, Cheyenne, WY 82002) and the WDEQ Director (Director, Wyoming Department of Environmental Quality, 200 West 17th?Street, 4th?Floor, Cheyenne, WY 82002) and state the grounds for the request.? The Council shall hold hearings pursuant to the WDEQ Rules of Practice and Procedure.
All written comments and requests received prior to 5:00 P.M, August 25, 2023 in the Cheyenne office will be considered.? Electronic comments may be submitted to the link identified above.?
