America First Legal and Texas Public Policy Foundation Secure Preliminary Win in Litigation Against Biden’s ATF
WASHINGTON, D.C. – America First Legal (AFL) and the Texas Public Policy Foundation (TPPF) sued the Bureau of Alcohol, Tobacco, and Firearms (ATF) on behalf of our client, Michael Cargill, who owns and operates Central Texas Gun Works. Under the Biden Administration, the ATF has implemented a new policy to revoke gun dealers’ licenses for minor paperwork errors, which is flatly illegal and barred by the Gun Control Act, the statute that ATF claims to be enforcing.
This week, AFL and TPPF secured a preliminary victory in the case when U.S. Magistrate Judge Dustin Howell of the Western District of Texas recommended that the Biden ATF’s Motion to Dismiss be denied, allowing our lawsuit on behalf of Michael Cargill to proceed to the merits.
He recommended that ATF’s motion to dismiss be denied because our client faced the prospect of actual harm from the challenged policy. This is a significant step towards victory for our client and the continued vindication of Americans’ right to bear arms.
The Biden Administration believes that if they can shut down the law-abiding gun stores, they can limit Americans’ ability to keep and bear arms through the back door. AFL will not stand idly by and allow this to happen and is proud to partner with TPPF to advance the rule of law for our clients.
