John,

Donald Trump posted on Truth Social yesterday that he received a target letter from Special Counsel Jack Smith’s team as part of their investigation into the January 6th insurrection.

John, Trump gets a lot wrong in this post. But one thing he’s right about is that this target letter signals he may be indicted soon.

We’ve been analyzing what that indictment could look like, and these are charges we think may be brought against Trump:
  • Conspiracy to defraud the United States (18 USC § 371)
  • Obstruction of an official proceeding (18 USC § 1512(c))
  • False statements (18 U.S.C. 1001)
  • Insurrection and giving aid or comfort to insurrectionists (18 U.S.C. § 2383)
  • Wire fraud (18 U.S.C. 1343)

An indictment of Trump for his efforts to disrupt the peaceful transfer of power and keep himself in office despite losing an election would be crucial for the future of democracy in America. We’ll be sure to keep you updated in the coming days with any news.

And just a reminder: while indictments do not necessarily disqualify Trump from holding office, the Constitution’s Disqualification Clause does. CREW is preparing to go to court to enforce Trump’s disqualification from office, based on his incitement of insurrection following the 2020 election.

If you support our work to hold Trump accountable and disqualify him from office, please consider making a MATCHED donation to CREW today. >>

Thank you,

Team CREW
