Now that we’ve had some time to digest the disastrous recent Supreme Court term, I wanted to share my thoughts on why a couple of their decisions will be so harmful to people in Illinois’ 17th District – and all over the country.

WCBU: "U.S. Rep. Eric Sorensen says Supreme Court is 'legislating from the bench'"

I recently said SCOTUS was “legislating from the bench” – and I meant it. The right-wing majority on the court is creating a new landscape of laws, rather than interpreting existing ones as the Constitution requires.

Here’s what I mean:

First, affirmative action. The court held that colleges cannot take race into account in university admissions, asking them to turn a blind eye to hundreds of years of discrimination and injustice that inevitably touch the experiences of every Black and brown citizen. This radically changes the rules, forcing schools to upend tried-and-true admissions policies. And make no mistake: this decision will make our universities less diverse.

Second, LGBTQ+ rights. The court decided that businesses can withhold service from LGBTQ+ folks if those businesses claim providing service would conflict with their religious beliefs. In this case, SCOTUS basically said they’re fine with discrimination against LGBTQ+ people – folks like myself and thousands of IL-17 residents. In other words, they changed the way businesses can operate – that’s legislating from the bench.

A blue Congress next cycle would go a long way toward checking the Supreme Court’s power. And the first step toward flipping the House blue is defending key swing districts like IL-17.
