Several Democratic presidential candidates have included in their policy platforms support for “decriminalizing” illegal border crossings. What would “decriminalizing” illegal border crossing actually mean? Much of the confusion around these issues is because of the nature of immigration enforcement itself—is it “criminal” or “civil” enforcement? This brief seeks to answer those questions.

The first three months of fiscal year 2020 show that apprehensions have continued to decline as fewer families arrive at the U.S.-Mexico border. However, Mexican immigration enforcement data and U.S. Migration Protection Protocol data suggests that Mexico’s clampdown and the MPP program may be producing diminishing returns in further reducing apprehensions.
