John,

Earlier this month we filed our defamation lawsuit against Congresswoman Lauren Boebert.

Fox News played a role in providing Boebert a platform to  defame our PAC, myself, our staff, and our donors.

It didn’t have to be this way for them though…

I reached out to Fox multiple times to offer them an easy out which would’ve precluded them getting involved in the litigation we are pursuing against Boebert. I emailed Rupert Murdoch, Lachlan Murdoch, and Suzanne Scott - all senior leadership. Our offer was simple: Bring us onto a segment of a Fox News program and let us refute the claims that Boebert made against us.

Last Friday, Fox's counsel denied our final olive branch.  We now may add Fox News to our lawsuit.

Take a look at the note Fox’s counsel sent to our legal team. I thought it was laughable:

For some more background as to why we’ve reached out to Fox so many times:

In 2022, we released multiple fact-based scoops about Lauren Boebert and her misdeeds, many of which called into question her so-called conservative values. In response, Boebert went onto Fox News and other right-wing media outlets defaming us, our PAC, and our donors, claiming that we were liars.

We reached out to Fox News repeatedly before and after the airing of Boebert’s segments on Hannity with definitive evidence that the claims our PAC was making about her were indeed true.  They refused and only read a portion of my response. The bare minimum. They refused to allow us to tell our side of this story and, instead, assumed everything she was saying was true.

The single sentence Fox and Sean Hannity allowed in from us..

We believe there are several parallels between our case and the recent Dominion case which bode extremely well for us.

Dominion Voting Systems, an electronic voting machine firm, won $750 million in damages after their victory, in a settlement, for a defamation lawsuit against Fox that claimed several Fox program hosts and guests made false claims that Dominion's voting machines had been rigged to steal the 2020 United States presidential election from then-president Donald Trump.

Dominion won their case, through a settlement, because they were able to show that Fox News continued to broadcast lies even after the plaintiff sent verifiable information demonstrating the falsity of the claims they were making.

The parallels to our case are huge

Fox News knew that Boebert was lying.  They coordinated her appearance the same date we published the allegations.  They had her on their shows, but even when we requested to appear they wouldn't allow us on air to refute her defamatory statements. It was a coordinated effort by Boebert, her staff, and Fox News staff.

Fox News staff allowed Boebert to simply run her mouth with whatever she wanted to say.  They did no research on her claims, didn't challenge her, nor did they even look into the verifiable information we sent to them that demonstrated Boebert was lying

Though we aren’t seeking a billion dollars like Dominion, Fox News will now have to face the music for not adhering to the universal journalistic standards of truth and fair reporting. Can I count on you to make a donation of $25 or whatever you can spare to help us bring justice to Fox News by bringing them onto the case we have filed against Lauren Boebert?

It’s about time that Fox faces some consequences. Thank you in advance for your support.
