Late Thursday, the U.S. Department of Justice (DOJ) filed yet another motion to dismiss the youth-led Juliana v. United States climate case, despite a recent ruling from U.S. District Court Judge Ann Aiken that the case could proceed to trial.
The DOJ filed this motion just ONE DAY after an online petition, signed by more than 255 organizations and over 50,000 individuals, was delivered to the DOJ by the People vs. Fossil Fuels coalition, urging Attorney General Garland to end opposition to the Juliana case proceeding to trial. And only TWO days after Our Children’s Trust lawyers concluded trial in Held v. State of Montana – the first ever children’s constitutional climate trial in the U.S.
While Judge Ann Aiken already ruled that Juliana v. U.S. can finally proceed to trial, this motion to dismiss filed by Biden’s DOJ on Thursday tells us that they are still using the Trump DOJ playbook to try to keep this case - and these 21 young people - from being heard in open court.

The motion to dismiss filed on Thursday is just a first step by the DOJ to try to prevent or delay trial in Juliana v. United States. Attorneys at the DOJ told attorneys for the youth just last week that they haven’t yet decided whether they will file another petition for Writ of Mandamusto try to impede the case further - this extreme step would come later in the process after Judge Aiken rules on their motion to dismiss - so we still have time to act!
