It’s been two weeks since Donald Trump was indicted by a federal grand jury on 37 felony counts for the willful mishandling of highly classified documents.
The evidence contained in the indictment is so damning that Bill Barr, Trump’s own former attorney general, said, “If even half of it is true, then he's toast.”
Now, backed into a corner and facing the potential of serious prison time, Trump has become perhaps even more dangerous than he was before, doubling down on conspiracy theories and appearing to openly incite violence against prosecutors and anyone else who dares challenge him.
However, there is a solution already written right into the U.S. Constitution. The 14th Amendment specifically bans anyone who has engaged in insurrection from holding public office again, and a growing list of constitutional experts have said that this provision disqualifies Trump from running.
But to keep Trump off the ballot, we must convince state election officials to enforce the 14th Amendment — and with filing deadlines for the 2024 elections approaching in the next six months, we don’t have much time.

In the days following his indictment, Trump assailed “the ‘Thugs’ from the Department of Injustice,” called Special Counsel Jack Smith a “deranged lunatic,” and recast his bid for the White House as a “final battle” for America.
In a speech the following Saturday, Trump characterized the entire American justice system as deployed to prevent him from winning the 2024 election. “These people don’t stop and they’re bad and we have to get rid of them. These criminals cannot be rewarded. They must be defeated.”
Meanwhile, Arizona Republican Kari Lake appeared to openly advocate for violence against law enforcement, saying, “If you want to get to President Trump, you’re going to have to go through me and you’re going to have to go through 75 million Americans just like me. Most of us are card-carrying members of the NRA.”
Louisiana Congressman Clay Higgins tweeted, “This is a perimeter probe from the oppressors. Hold. rPOTUS [a reference to the real president of the United States] has this. Buckle up. 1/50K know your bridges. Rock steady calm. That is all,” suggesting guerilla warfare.
These are exactly the kind of insurrectionist threats that the 14th Amendment was created to address.
The problem is that the corporate media continues to either ignore the 14th Amendment or treat it like some left-wing fantasy, rather than the law of the land. That will make it extremely difficult politically for state election officials to enforce the 14th Amendment and keep Trump off the ballot.
