John, Since the Supreme Court’s 2010 Citizens United decision declared that corporations have the right to spend unlimited sums of money to influence our elections, our political landscape has shifted drastically. Corporate and super PAC spending in elections shatters records year after year, with the 2022 midterm elections seeing over $1.2 billion in contributions from the 100 biggest donors. Free Speech For People was founded on the day of the Citizens United ruling with the goal of restoring a democracy by and for the American people, not corporations and megadonors. Now we are one step closer to reaching that goal. Today, U.S. Representative Jim McGovern introduced the Free and Fair Elections Amendment, which would overturn Citizens United and reclaim our democracy. In doing so, it would uphold the fundamental promise of political equality for all. And unlike other amendments that would merely allow Congress to pass federal campaign finance legislation (which it might not do) for federal elections, the Free and Fair Elections Amendment directly imposes these key elements in the amendment itself without any further action from Congress. In addition to overturning the Citizens United decision, the Free and Fair Elections Amendment would: - prohibit corporate spending in the political process
- set limits on federal campaign contributions and spending
- require Congress to develop a system of public campaign financing for all federal candidates who qualify for the ballot--and if Congress doesn’t, then its members don’t get paid; and
- allow states to set reasonable limits on campaign contributions and spending in state and local elections.
