My apologies for sending out a second KCDC Disability News message today, but I just received the following request for comments from the Kansas  Department for Aging and Disability Services (KDADS) on proposed amendments to their Home and Community Based Services (HCBS) waivers.  Request for Comments

The Kansas Department for Aging and Disability Services (KDADS) is amending the following Kansas Medicaid 1915(c) Waivers: Autism (AU), Brain Injury (BI), Frail Elderly (FE), Intellectually and Developmentally Disabled (I/DD), Technology Assisted (TA), and Physically Disabled (PD).

 The proposed amendments cover the following:

  • Standardizes Performance Measures across the waivers (Performance measure standardization for the TA waiver is captured in its pending renewal.)
  • Unbundles Assistive Services into three services: Home Modification, Vehicle Modification, and Specialized Medical equipment and Supplies
  • Requires Provisional Plan of Care across the waivers
  • Authorizes Residential Services for Married Couples on I/DD Waiver
  • Amends Specialized Medical Care (SMC) Time Limits
  • Allows for Personal Care Services (PCS) to be delivered in Assisted Living and Home Plus settings
  • Adds virtual delivery of services as part of residential services on the I/DD Waiver and agency directed PCS
  • Allows for paid family caregivers for PCS

 The proposed effective date for the standardized performance measures for Autism (AU), Brain Injury (BI), Frail Elderly (FE), Intellectually and Developmentally Disabled (I/DD) and Physically Disabled (PD) waivers is January 1, 2024. 

 The proposed effective date for the remaining changes to the Autism (AU), Brain Injury (BI), Frail Elderly (FE), Intellectually and Developmentally Disabled (I/DD) and Physically Disabled (PD) waivers is September 1, 2023.

 The proposed effective date for the Technology Assisted (TA) waiver amendment is July 28, 2023.

 The Kansas Department for Aging and Disability Services is seeking public comments from June 22, 2023 through July 22, 2023 on the proposed amendments.

 The proposed amendment is posted on the KDADS website at www.kdads.ks.gov or may be requested from:
