In April: A federal district court in North Dakota blocked the EPA’s science-based rule defining the “Waters of the United States,” stripping protections from thousands of wetlands, streams, and interstate waters in 24 states. |
In May: The Supreme Court, led by conservative justice Samuel Alito, issued a 5-4 decision in Sackett v. EPA bulldozing the Clean Water Act and the very premise of our bedrock environmental laws. |
Now: Earthjustice is using every legal tool available to fight back against these devastating rulings and protect the Clean Water Act. But we are just eight days away from our fiscal year deadline on June 30, and still need to raise $134,000 to meet our budget goals. |

Not only does the Supreme Court’s ruling in Sackett pose an existential threat to clean water in this country by stripping protections for more than half the nation’s wetlands, it opens up new attacks against laws designed to protect the air we breathe, the food we eat, and the Earth we love. |
Earthjustice is responding with a coordinated campaign to fight back: |
- Our legislative team will work with Congress to fix the Clean Water Act and press states to enact more powerful clean water protections.
- Our clean water team will work to strengthen EPA protection and enforcement, and we will pursue litigation if necessary.
- Attorneys at our 15 regional offices across the country will sue wherever appropriate to protect wetlands and other bodies of water endangered by recent rulings.
