A few years ago in South Dakota, their petitions were challenged and the courts ruled that anything over 1% for ballot access was excessive. When this happens, laws in other states need to be challenged in court to get them to meet the new standard. This is what we are proposing.
Libertarian party help.
We initially proposed this to all the other "little parties,” including the Libertarian party of Minnesota. The Legal Marijuana Now party supports our lawsuit, but because they already have ballot access they would not have standing to sue therefore, they are not affected.
Lawyers are stating that the only path to victory would be with an established party, which would give us the greatest avenue to succeed. They were not willing, and we have not heard anything different from their chair since.
What we worked on, and helped organize was getting a major attorney who was willing to take the case pro-bono–David Schoen out of Atlanta. We would will still incur filing fees, transportation, and lodging costs for David, as well as the foremost ballot access expert in the country, Richard Winger of Ballot Access News. We also secured other parties who were willing to help shoulder the cost. The only piece left to join in the fight was the support of the Libertarian party.
Years before we’d gain enough signatures.
It will likely be years before we could muster the manpower needed to collect the required signatures. The Libertarian party has the manpower needed, along with a booth at the state fair.
I am confident that the Libertarian party will agree to lead this suit as it would be of great benefit to them as well.
Though we may not benefit from a lawsuit in the near future, this is the right thing to do. This year, the state made it harder for parties to gain ballot access. This kind of action cannot go unanswered. The people need to be able to choose from more than two options on the ballot, giving people the chance to be truly represented
