As temperatures climb above 100 degrees, the city of San Antonio may now, because of HB 2127, be unable to pass life saving protections that require water and rest breaks for construction workers.

 

Neither state nor federal law requires rest breaks for construction workers and OSHA’s general duty clause does not require an employer to take any specific action to protect workers who labor in dangerous temperatures, including providing rest and water breaks, no matter how high the heat index.

 

This is exactly why we fought so hard against HB 2127- it ties the hands of our local governments from protecting the people who they were elected to serve.

 

Prohibiting and eliminating rest breaks for construction workers in the Texas heat is cruel, reckless, and puts the lives of the workers who build our state at risk.
