WILL Wins, Again!

VICTORY | In Challenge to the MBDA, WILL Secures Yet Another Major Victory for Equality Under the Law

WILL won a preliminary injunction on behalf of several clients last Monday, challenging the Biden Administration’s racially discriminatory Minority Business Development Agency (MBDA) programming—a cornerstone of the Administration’s so-called “racial equity agenda.”

🗯 WILL President and General Counsel, Rick Esenberg, stated: “The federal court declared what we know is the law and the right thing: the government may not discriminate based on race. Without equality, our other rights mean little if anything at all. WILL is committed to preserving that fundamental principle and our fight is far from over.”

🗯 WILL Associate Counsel, Cara Tolliver, stated: “It is repugnant to human dignity to presume a diminished ability or inability to succeed, or to grant or deny a benefit, on the basis of race. The Biden Administration’s MBDA offers no constitutional justification for its broad race-based program. WILL will continue to vindicate basic notions of human dignity embraced in the doctrine of equality.”

🗯 WILL Client, Jeff Nuziard, stated: “The government cannot discriminate against its citizens on the basis of race. That’s the general guarantee established in our Constitution, and this ruling reaffirms it. I am grateful to WILL for fighting for equality under the law and fair treatment of all small businesses in America.”

NEW | WILL Launches New Lawsuit on behalf of Over 200,000 Firearm Owners Across America

WILL filed a new federal lawsuit against the Biden Administration on behalf of over 200,000 firearm owners across America in coordination with National Association for Gun Rights Inc. (NAGR) and Texas Gun Rights, Inc. (TGR).

Our lawsuit argues that a new rule from ATF usurps Congressional authority by significantly expanding the definition of “rifle” under federal law, imposing potential criminal liability on millions of Americans for exercising their Second Amendment rights.

🗯 WILL Deputy Counsel, Lucas Vebber stated, “The Biden Administration cannot ignore Congress and this rule is a clear violation of separation of powers and a violation of the Constitutional rights of all Americans. Now that the ATF’s rule is in effect, it’s critical that we act now.”

🗯 Dudley Brown, President of the National Association for Gun Rights, “Biden’s ATF is a rogue entity, making rules that plainly violate the Constitution. Their rule on pistol braces has turned millions of gun owners into felons, overnight. We’re taking legal action to rein the ATF in and restore the rights of our members. We are pleased to partner with WILL to do just that.”

🗯 Chris McNutt, President of Texas Gun Rights, stated, “The ATF are acting like foot soldiers for the anti-gun Biden administration. Their abuse of power is both unconscionable and unconstitutional. Texas Gun Rights looks forward to overturning their draconian rule.”

OP-ED | By Tackling Imaginary Racism In School Discipline, The Biden Admin Is Making Classrooms Less Safe

✍️ "Rather than exacerbating an environment of chaos by viewing discipline as racism, we should look at why  certain groups of students are misbehaving more in schools. Our kids and teachers should not have to wait for the next conservative president to institute new policies that will make them feel safe in their local schools," wrote WILL Research Director—Will Flanders, PhD—in The Federalist.

In this op-ed, Flanders explains that disciplining kids based on race instead of behavior is a policy being implemented right now by the Biden Administration. The kids most endangered are the same ones the policy is designed to help.

NEW | WILL Praises “Substantial Victory” for Parental Choice in Wisconsin

WILL released the following statement last Thursday, after an announced agreement between GOP Legislative Leaders and Governor Evers took place.

Under this new agreement, K-8 private institutions will receive about $9,500 per student, and private high schools will receive approximately $12,000.

These steps will empower families and students to find and receive a quality education—no matter where they live. It is an incredible step towards ensuring every child is valued equally, no matter what type of school door they may walk through.

NEW | WILL & School Choice Wisconsin Debunk Unfounded Claims Against School Choice Programs

Today, WILL and School Choice Wisconsin partnered together to release a new policy brief, “Best of Both Worlds: Voucher Schools Have Little Effect on Public School Test Scores.”

The findings cast doubt on a common narrative from school choice detractors that the expansion of choice will harm public schools.

🗯 WILL Research Director, Will Flanders, PhD, stated, “Once again, we see that the continued growth of school choice in Wisconsin has not negatively impact public schools. In fact, the competition encourages academic improvement in the public-school sector. Enacting school choice nationwide has the potential to raise standards and the quality of education, for all schools, and the proof is in the data.”

🗯 Mike Metoff, Outreach and Research Coordinator at School Choice Wisconsin, added, “We've known for a long time that private choice schools provide a tremendous education to students and are a value to taxpayers—now there's data that demonstrates public school students benefit as well. A thriving, well-funded choice infrastructure is critical for Wisconsin and will benefit students, families and communities all across the state."
