Holder: If Trump Had Returned the Documents, We Probably Wouldn’t Have a Case

Thursday on MSNBC’s All In, former Attorney General Eric Holder said that the indictment of former President Trump is based on obstruction and if Trump “had taken that material from the Justice Department and had done so improperly, but had given the material back once requested, my guess is that we probably would not have a case.”

Holder said, “The obstruction thing is the tipping point. If he had taken that material from the Justice Department and had done so improperly, but had given the material back once requested, my guess is that we probably would not have a case. But the fact that he frustrated attempts to get back information that he did not have the ability to possess, the obstruction is what makes this case one that you would ultimately bring.

“This is not an easy decision, in the sense that this will be something that the country will be talking about, potentially may divide the country,” declared Holder, who served in an administration that divided the country. “But if this is to be a nation of laws, if no one is truly above the law, and if you look at the history of these kinds of cases, where people who had almost clerical positions have been criminally charged, how do you give a pass to a President, to a former President of the United States, especially given the obstructive behavior?”

Democrats love to pontificate about no one being above the law, while holding every single member of their Party above the law.

Holder Calls for Democrats to Pack the Supreme Court

Addressing a virtual seminar on “Court Reform” hosted by the Brookings Institution on January 25, 2021, Holder said that President Trump’s three Supreme Court appointments had “sowed doubt” about the Court’s judicial independence. Claiming that Senate Majority Leader Mitch McConnell in 2016 had concocted a rationale out of “thin air” to block the confirmation of Obama nominee Merrick Garland to the Supreme Court, Holder stated that if Garland had been confirmed, a liberal-majority Court would have brought four years of “progressive” decisions. He also said that the 2020 confirmation of Amy Coney Barrett to the Court constituted a Republican power grab. Thus, Holder concluded, Democrats “must use the power that they now have.” “I believe it would be totally appropriate to add additional seats to the Supreme Court, in response to what has transpired over the past few years,” he said.
