This is incredible news, John: The Supreme Court’s ruling in Allen v. Milligan has upheld key provisions of the Voting Rights Act!
For decades, the Voting Rights Act has represented the crown jewel in the legacy of the Civil Rights Movement. This legislative accomplishment moved us closer to achieving equal treatment under the law, and it was repeatedly reauthorized by overwhelming bipartisan majorities in Congress, including a 98-0 vote in the Senate to reauthorize it most recently, in 2006.
But recently, the Voting Rights Act has come under attack. Ten years ago, the Court’s ruling in Shelby County dismantled portions of the VRA, effectively nullifying Section 5. Section 5 was a critical tool to hold states accountable, specifically states with a history of racial discrimination. Under Section 5 these states needed to receive preclearance before passing new election laws. Eliminating this check in the disastrous Shelby County ruling opened the door for a new wave of voter suppression laws across the country.
In Allen v. Milligan, Republicans asked the Court to further undermine the VRA by invalidating provisions that prevent lawmakers from diluting the political power of communities of color. By rejecting these arguments, today’s ruling helps ensure that the Voting Rights Act will continue to serve as an important tool to make our democracy fairer.
That said, while today’s ruling represents a victory for our democracy, this is not the end of our fight against voter suppression. Too many politicians across the country are determined to hold on to unearned power by restricting and undermining the right to vote.
