This ruling is a blow to decades of efforts to clean up and protect the nation’s waters. Millions of acres of formerly protected wetlands are at risk from polluters and developers.
The Clean Water Act was enacted to restore and maintain the integrity of the nation’s waters, ensuring that they are safe for drinking, wildlife, and recreation. The science is clear that wetlands and headwater streams are essential to protecting downstream waters.
But under SCOTUS’ arbitrary and unscientific new standard, only wetlands with “a continuous surface connection” with a protected waterway — a connection where it is “difficult to determine where the ‘water’ ends and the ‘wetland’ begins” — will be protected.
In other words, if a wetland is not visibly connected to another body of water, no matter how essential it is for habitat, flood control, or filtering pollution, then that wetland is not protected under the Clean Water Act!
