Section 3 of the 14th Amendment to the Constitution, also known as the Disqualification Clause, makes clear that people who have sworn an oath to the Constitution who then engage in insurrection are disqualified from serving in public office.

This 150+ year old provision is newly relevant in the aftermath of the Capitol attack on January 6, 2021: we can use the Disqualification Clause to prevent insurrectionists from running for office, or staying in office.

How do we know we can do it? Well, we already have.

Can we really use Section 3 of the 14th Amendment to remove insurrectionists from office?

YES! In fact, CREW did it before.

New Mexico’s Otero County Commissioner Couy Griffin traveled across the country to recruit people for battle on January 6th, marched to the Capitol with members of the armed mob that assembled for President Trump’s “Stop the Steal” rally, then illegally breached the Capitol’s security barriers and occupied restricted grounds.

Couy Griffin breached police barriers protecting the Capitol grounds on January 6th as part of an organized effort to halt the certification of a free and fair election. Under the Constitution, those office holders who, like Griffin, violated their oath by participating in or aiding an insurrection, must be barred from public office.

CREW took this argument to court – and we won. Thanks to our work, Couy Griffin was disqualified and removed from office in New Mexico for participating in the January 6th insurrection.

But Couy Griffin is just one insurrectionist. There are others who are seeking public office, or who hold office – including Donald Trump himself.

CREW is preparing to enforce Trump’s disqualification under Section 3, as well as the disqualification of others who engaged in and incited the insurrection.

Where else and how else can we prevent insurrectionists from holding office?

In many states, election officials, like secretaries of state, can enforce the Disqualification Clause by removing insurrectionists from the ballot, or legal challenges can be brought in court to do the same. And some states are also taking steps to explicitly bar insurrectionists from holding certain government positions by considering new state laws.

CREW is also currently working in 15 states to stop insurrectionists from holding office.

We continue to pursue legal accountability for local insurrectionists, educate local leaders about Section 3, and support state legislation barring insurrectionists from office.

We’ve called for the investigation and potential disqualification under Section 3 of state representatives, U.S. House representatives and other government officials in Alaska, Arizona, Michigan, New Mexico, North Carolina, Pennsylvania, West Virginia and Wisconsin.

We sought public records in Maryland regarding state representatives’ participation in the insurrection and we’ve helped multiple states draft legislation that would prevent insurrectionists from holding office.
