*Notice of adopted rules and rules filings for Paid Family and Medical Leave*

On May 17, 2023, the department filed a CR-103 and adopted rules regarding employer reporting requirements, placement, elective coverage requirements, and designated representatives. The adopted rules add two requirements for employer quarterly reports. The first is a report of ?no payroll? for a maximum of eight consecutive quarters when employers have no paid wages to report. The second is a requirement to add employees? dates of birth to quarterly wage reports. Adopted amendments also clarify the definition of placement, clarify benefit eligibility for self-employed elective coverage, and clarify provisions that allow designated representatives to file weekly claims.

On May?17, 2023, the department also filed two CR-101s to consider rules implementing legislation that passed during the 2023 legislative session. The first CR-101 is regarding Substitute House Bill 1570. Topics for this rulemaking may include details regarding how the pilot program created by the bill will be implemented and administered. The second CR-101 is regarding Substitute Senate Bill 5286 and Substitute Senate Bill 5586. Topics for this rulemaking may include annual premium rate calculation and employer access to certain information regarding an employee?s use of Paid Leave.
