John, Section 3 of the Fourteenth Amendment makes clear that anyone who has previously sworn an oath to uphold the Constitution, and then engages in “insurrection or rebellion” against the United States (or provides “aid or comfort” to its enemies) is permanently disqualified from holding future public office. Yet several elected officials, including Arizona Rep. Paul Gosar, North Carolina State Rep. Donnie Loftis, and Pennsylvania State Senator Doug Mastriano, remain in power following their support for the January 6th insurrection. Gosar went so far as to suggest immunity for those who stormed the Capitol. Mastriano not only mobilized the mob but also participated in the fake electors' scheme and joined the mob within the restricted area of the Capitol grounds, offenses that warrant an investigation under Pennsylvania Senate rules and the state’s constitution.
