FSC Files Lawsuit Against Utah

FSC has taken a stand against Utah's antiporn ban by filing a lawsuit in federal court. Joined by esteemed individuals and organizations, we are fighting to overturn this law that violates the 1st and 14th Amendments. The Utah law restricts adults' access to legal speech and goes against Supreme Court precedent. Our complaint highlights constitutional issues, including prior restraint of speech and violations of the Communications Decency Act. Despite raising concerns during the legislative process, our efforts were ignored. We believe the proposed solutions burden free expression unreasonably. An Open Letter to Senator Weiler

FSC has written an open letter to Senator Todd Weiler expressing concerns about the recently sponsored bill, SB 287. FSC highlights the law's vague and contradictory requirements, making it difficult for their members to comply. They emphasize the lack of clarity in approved age verification methods and the undefined criteria for determining which sites need to implement age verification. Read more on our blog. Addressing Challenges As Utah Age Verification Begins

As Utah's age verification requirements come into effect this week, we have highlighted the complexities of compliance. While the legislation aims to protect minors, there are a lack of clear methods to verify age and the limited options available for websites. Similar issues have arisen in other states that have passed AVS laws. FSC is actively exploring solutions and engaging with Utah officials to ensure website compliance. Meanwhile, we advise considering various approaches, such as partnering with AVS providers or implementing paywalls. Republicans Are Coming to Take Your Porn (Again)

Several Republican states have introduced laws requiring age verification before viewing "material harmful to minors" online. These laws, which have been passed or are pending in more than a dozen states, have been framed as measures to protect children, but some advocates argue that they represent a broader effort by the Christian right to ban or censor protected speech. Critics argue that the laws could be applied to a wide range of websites and could result in the censorship of critical information about sexual health and gender. Read more on RollingStone. Porn Industry Group Sues Over Utah's Age Verification Law

The state of Utah is facing a lawsuit over a law that requires pornography websites to verify the age of their users before allowing them to access adult content. The lawsuit argues that the law violates the First Amendment and would be difficult to enforce. The law, which was set to go into effect on July 1, 2021, has been put on hold by a federal judge pending the outcome of the lawsuit. Read more on Axios. ( [link removed] )
