But often, employment contracts force employees into for-profit arbitration, where the employer usually wins because arbitrators survive on the repeat business that will go away if they rule in favor of the employee.
As if workers of color don’t have the deck stacked against them already.
Last year, we proudly passed similar legislation banning forced arbitration in employee lawsuits over sexual assault. President Biden signed it into law. We can do the same thing with racial discrimination — workers should have the right to take their claims to court if they choose, instead of being forced into arbitration.
