Last week, a lawsuit in New Mexico aimed to dismantle the state’s abortion protections by using a 150-year-old federal law, the Comstock Act, to criminalize the distribution by mail of “obscene” materials—including materials used to end a pregnancy.
To meet this moment, Democrats in Congress need to introduce a bill to repeal the Comstock Act as soon as possible. Force a vote. Attach the repeal as an amendment to other bills coming down the pipeline. Talk about it to voters. They must match the urgency of this threat.

National Democrats must explore every avenue for protecting abortion rights nationwide. They owe it to their prochoice voters, who turned out in November largely because of attacks on abortion.
In another case filed just days ago, Judge Robert Chambers took a different approach to the Comstock Act, ruling that it does not bar mailing abortion pills, that state officials do not enforce Comstock, and that the law has been "widely abrogated."
This is good news—but with Trump-appointed judges all over the country ready to pounce, it’s clear that we need decisive congressional action. Congress must repeal the Comstock Act to remove any possible threat to access to abortion pills.
