John, when reproductive freedoms are on the line in Wisconsin, it’s our job to make sure that you’re up-to-date on everything that’s going on.
What’s happening right now is a little bit complex, but we’re here to help break it down for you:
FIRST: In June, Attorney General Josh Kaul filed a lawsuit seeking to repeal the 1849 abortion ban, arguing that it is from a bygone era and was adopted without public input
THEN: Legal arguments for the lawsuit were heard today in the Dane County Circuit Court. The judge who was hearing the case is not going to rule on anything yet.
NOW: Even if the judge rules against the 1849 abortion ban, the GOP will likely appeal the ruling and the case will end up before our state Supreme Court.
This is a unique situation, John. Ordinarily, an appeal of the trial court’s decisions would go to the court of appeals. But there is a process for expedited review that the Supreme Court can grant – and it would likely be granted in this case.
Now, we’re in the middle of a waiting game to see how long it will take before this case makes its way to our Supreme Court.
The good news is: we don’t have to stop supporting pro-choice advocates in the meantime.

The fall of Roe v. Wade reinstated Wisconsin’s cruel abortion ban from 1849 that provides no exceptions for rape or incest and could jail or fine doctors. But we know the right-wing won’t stop there. Governor Evers has already vetoed nine anti-abortion bills that passed the GOP-controlled legislature, and when he called for a special special to repeal the 1849 law, Republicans gaveled in and out in less than a minute.
At Women Win Wisconsin, we believe the key to stopping the GOP is to activate the overwhelming majority of voters who support reproductive freedom. A recent Marquette University Law School poll showed 80% of Wisconsin voters are concerned with the change in abortion policy now that abortion is illegal in the state. These voters can make the difference in Wisconsin races that are often decided by only a few hundred votes.
