The Democratic Republic of the Congo (DRC) is currently experiencing widespread armed conflict and intense violence, making it unsafe for its nationals to return home.

The region has suffered decades of tragedy, claiming over 5 million lives — one of the deadliest armed conflicts in modern history. The resurgence of the non-state armed group March 23 Movement (M23) has contributed to the violence and human rights abuses, including war crimes. In 2022 alone, over 6,000 lives were lost and two million people were displaced.

This is why Congress created the Temporary Protected Status (TPS) program: to extend protections from deportation and allow individuals to work legally in the U.S., providing a safe haven for those who come from countries where it is unsafe to return. The dangerous and deadly conditions in the DRC meet the statutory requirement warranting a TPS designation for the country, making clear that the Biden Administration has an obligation to designate the DRC for TPS without delay.

The continued conflict in the DRC is only adding to the number of refugees and displaced people in the broader region. Individuals fleeing danger in the DRC have few places to go in the region, as surrounding countries are unlikely to offer safe haven.

Designating the DRC for TPS would provide vital protections to Congolese nationals currently living in the U.S., allowing them to remain with their families in their communities, and free from the fear of deportation to harm. If deported to the DRC, families could face horrifying violence and human rights violations, including arbitrary detention, sexual and gender-based violence, torture, forced recruitment as soldiers, and even summary executions.
