UPDATE | WILL Participates in Summary Judgment Hearing in Parental Rights Case versus KMSD | |
WILL and Alliance Defending Freedom (ADF) presented arguments in a summary judgment hearing last Wednesday regarding a prominent parental rights suit against the Kettle Moraine School District (KMSD). WILL and ADF have been fighting this case since 2021.
🗯 WILL Deputy Counsel, Luke Berg, stated, “Parents have a constitutional right to make the best decision on behalf of their child, especially when it deals with a potentially life-altering decision. KMSD’s policy denies that right while simultaneously flouting the qualified medical perspectives provided by WILL’s and ADF’s expert witnesses, Dr. Erica Anderson and Dr. Stephen Levine.”

NEW | WILL Demands Answers Following Troubling Locker Room Incident | |
WILL is demanding answers and action from Sun Prairie Area School District (SPASD) after a significant allegation involving a violation of girls’ locker room privacy at East High School. WILL’s letter provides more details on this incident and SPASD’s inadequate response.
🗯 Libby Sobic, WILL Director of Education Policy, stated, “School districts need to think through what loosening boundaries for single-sex spaces could mean for girls. Parents are understandably concerned about whether school districts—like the Sun Prairie Area School District—are doing everything required to protect girls in bathrooms and locker rooms. WILL is calling on the district to act promptly to restore a sense of safety and privacy in its schools.”
🗯 Dan Lennington, WILL Deputy Counsel, added, “Public schools have two basic jobs: educate our kids and keep them safe. All too often our schools can’t do either. This is a wakeup call to all parents and taxpayers to become more informed about their local public school district and demand accountability.”

UPDATE | Open Government Protection Act Passes WI State Senate Unanimously | |
Last Wednesday, WILL praised the Wisconsin Senate’s passage of The Open Government Protection Act (Senate Bill 117). The legislation would make clear that a party “prevails,” and may recover their attorney fees under state law, when a government agency releases records after a lawsuit is filed. The bill passed unanimously on a voice vote.
🗯 WILL Deputy Counsel, Lucas Vebber, stated, “The ability to request public records is vital to ensuring transparent and accountable government. This legislation will continue ensuring that government actors produce public records in a timely manner. We are excited to see this important bipartisan reform pass the State Senate unanimously, and hope the Assembly will quickly follow suit so this can get to the Governor’s desk.”
The bill is supported by WILL, Wisconsin Freedom of Information Council, Wisconsin Newspapers Association, Wisconsin Broadcasters Association, Wisconsin Transparency Project, Americans for Prosperity, Wisconsin Manufacturers and Commerce, Wisconsin Realtors Association, and the ACLU of Wisconsin.
