MONDAY E'NEWS Legislative Update 4.24.23 On a party-line vote, the Michigan Senate on Wednesday concurred in the House changes in the Red Flag legislation described in last week's E'News. The package is now on its way to Governor Whitmer. This was the third and final item of the Michigan Democrats' initial gun control efforts. The governor previously signed storage mandates and long gun background checks into law. The chart following this article explains how the new long gun background check law will impact both private party long gun and pistol sales once it goes into effect around April 1, 2024. Several members of the House Democratic Caucus do not support a ban on modern rifles in Michigan. Given that Democrats have a bare majority in that chamber and need every one of their 56 votes to pass the legislation, an "Assault Weapons Ban" appears to be dead at this point in time. It is unlikely Democratic leadership would be able to find several Republican to vote for a ban on modern rifles. In its place, Democrats intend to introduce a ban on the sale of standard capacity magazines holding more than 10 rounds. That bill is expected to require the reporting of currently owned magazines holding more than 10 rounds to police. Beyond the standard capacity magazine ban, legislative Democrats have said their other gun control priorities for 2023 include removing liability protections for firearms manufacturers, imposing an eight year prohibition on firearms sales to people convicted of misdemeanor domestic violence, and the creation of gun free zones at polling places. Of those three, the domestic violence legislation is the most likely to pass. It would mirror current federal law. The bipartisan Safe Schools Package that has sat ignored in House Education Committee during the gun control push will likely receive hearings in June.
