The brief contends that Roe has remained “radically unsettled” 47 years after the ruling. “After abandoning the constitutional rationale for the abortion right espoused in Roe, a majority of the Court has not settled on a coherent rationale, and the centralization of the abortion issue in the Court has made the Court and the Justices the focus of ferocious campaigns of personal destruction,” wrote Clarke Forsythe, counsel of record.
