John -- The team here at All On The Line wanted to send you an update on Moore v. Harper, one of the redistricting cases in front of the Supreme Court.
Our team has been in the weeds on this case for a while now -- our affiliate organization, the National Redistricting Foundation, is supporting the voters who are fighting for the fair congressional map in North Carolina.
Extreme North Carolina Republicans are attempting to replace that fair map with the gerrymandered one that the state supreme court deemed unconstitutional.
But their legal argument -- the “independent state legislature” theory -- has no sound legal support. And in fact, it runs counter to more than 100 years of legal precedent established by previous SCOTUS decisions.
These extreme Republicans claim that state courts don’t have the power to decide whether state legislation regarding federal elections, such as the drawing of congressional maps, complies with -- or runs afoul of -- state laws. But in the landmark redistricting case Rucho v. Common Cause, Chief Justice Roberts explicitly pointed to the ability of state courts to enforce state laws as an example of checks and balances in the redistricting process that can protect voters from extreme gerrymandering.

Demanding that gerrymandered state legislatures have unilateral power over congressional redistricting -- with no judicial oversight from state courts -- is pretty ridiculous.
Voters sent a clear message when election deniers in places like Arizona, Michigan, and Pennsylvania lost their elections and failed to secure power as governors or secretaries of state. Voters do not want extremists to have power over elections without checks and balances.
