Yesterday, the U.S. Supreme Court announced it will continue to block Judge Matthew Kacsmaryk's radical court ruling that would revoke the Food and Drug Administration's decades-old approval of mifepristone—one of two drugs used in medication abortion. The ruling will remain blocked until at least midnight on Friday.
For now, mifepristone remains available while the high court continues to review the case and consider whether to issue a longer-term block on the ruling.
Providers and patients should not be in this position. No matter what the Supreme Court does next, this case has already caused chaos and confusion that undermines our rights to reproductive freedom and bodily autonomy.
The ruling made by Judge Kacsmaryk was wrong on the facts and wrong on the law. This temporary reprieve should not distract us from the threat posed by the plaintiffs' ask and their true intent: to ban medication abortion nationwide.
