Let’s break down the ruling as it stands and what's next in the fight for abortion freedom.
In a coordinated attack on nationwide abortion access, Judge Matthew Kacsmaryk ruled in favor of anti-abortion groups and suspended the FDA approval of Mifepristone.
It’s important to note that Mifepristone remains available right now since Judge Kacsmaryk stayed his own ruling for seven days, until this Friday.
Misoprostol, the second drug used in standard medication abortions, is also still available and is unlikely to face a ban due to its other uses. In states that have not banned abortion, abortion is still legal, and safe medication abortions will continue to be available with Misoprostol only if the Department of Justice’s appeal fails.
Let's be clear — abortions with Misoprostol only are safe and effective, full stop. And still, Judge Kacsmaryk’s ruling is not only outrageous and founded on easily disproven claims, it’s also unprecedented. Courts have never before revoked a decision made by the FDA based on science,1 and setting this legal precedent could lead to similar partisan decisions on contraceptives and vaccines.
And with a different judge in Washington state issuing a contradictory ruling that same night, requiring the FDA to maintain access to Mifepristone in 17 states and the District of Columbia, this matter will most likely be decided by the Supreme Court.2
Amidst this uncertainty, we need to take action to support those providing abortion access and ensure that our voices continue to be heard by all decision makers.
