John, this picture was taken on Jan. 6, 2021. The man on the left is Doug Mastriano, who breached police lines shortly after this picture was taken during the insurrection:

Doug Mastriano is a Pennsylvania State Senator. And the evidence shows that he likely engaged in insurrection in the lead-up to the January 6th attack on the Capitol — even busing in Trump supporters on that day and breaching police lines. This is the clearest photo from that day, but many others show him immersed in the mob that tried to stop the transfer of power.

That means there’s a strong case that he is ineligible to serve in office under Section 3 of the 14th Amendment of the Constitution.

The facts provide a strong argument that Doug Mastriano is disqualified from holding public office under the Disqualification Clause of the U.S. Constitution. As detailed in our full report, those facts indicate Mastriano:
  • Helped to mobilize and incite the mob ahead of January 6th, including by spending thousands of dollars in campaign funds to charter buses to transport Trump supporters to Washington, D.C. for the day’s events,

  • Played a pivotal role in the fake electors scheme, a plot which the January 6th Select Committee concluded “led directly to the violence” on January 6th, and

  • Personally joined the mob within the restricted area of the Capitol grounds on January 6th before ultimately leaving.
Our team here at CREW has removed insurrectionists from office before. In New Mexico, Otero County Commissioner Couy Griffin was removed from office after a judge ruled in our case that the attack on the Capitol was an insurrection and that Griffin’s participation in it disqualified him under Section 3 of the 14th Amendment.

We are ready to apply that same argument to every insurrectionist in office – including State Senator Doug Mastriano.
