Justice Sotomayor pens decision for PLF clients

 

“Larry Steven Wilkins and Jane Stanton wanted quiet titles and a quiet road,” Justice Sonia Sotomayor writes in the first line of the Supreme Court’s decision in Wilkins v. United States, which PLF argued at the Court in November. Justice Sotomayor and five of her colleagues sided with PLF’s clients, who are challenging the federal government’s land grab of a private forest road.

Cook County rescinds discriminatory grant program

 

Like many businesses in Cook County, Illinois, Dr. Domenic Cusano’s Chicago-based chiropractic clinic suffered great financial losses under the government’s COVID-19 policies. The county offered grants for economic relief, but the program prioritized business owners from “historically excluded populations.”

With PLF’s help, Dr. Cusano sued, arguing the program violated his right to equal treatment under the law. In response, the county terminated the discriminatory program altogether, Andrew Quinio reports.

Ninth Circuit rules Seattle ‘Fair Chance’ housing ordinance unconstitutional

 

On March 21, the U.S. Court of Appeals for the Ninth Circuit ruled that the government cannot prevent landlords from asking about applicants’ criminal histories when selecting tenants.

This decision in Yim v. City of Seattle is a stunning win for the First Amendment, rejecting Seattle’s 2017 “Fair Chance Housing Ordinance” that forbade landlords from asking about or considering prospective tenants’ criminal backgrounds.

As Ethan Blevins puts it, “The government does not get to decide what information people can or cannot possess.”
