We have a situation heating up in Kansas that you should know about.

The Convention of States Resolution was officially voted on in the floor of the House with a vote of 74-48 and in the Senate with a vote of 22-16 — two strong votes in both chambers in our favor!

In any other state in the U.S., that would be it. We could declare victory, and Kansas would officially be the 20th state to join the call for a Convention of States.

But Kanas is unique.

Thanks to the infamous “Roe Rule,” the Kansas Constitution requires any Article V effort in Kansas to secure a two-thirds majority to pass. This special stipulation was adopted shortly after the Roe v. Wade decision in 1973 to stop any effort in Kansas to overturn that decision. This was the sole reason why both the House and the Senate gaveled down our Convention of States resolution as “not passed.”

This is blatantly unconstitutional.

Former Kansas Attorney General Derek Schmidt recognized this in an official opinion. Because Article V of the US Constitution gives the authority to apply for a convention solely to the state legislatures, state constitutional provisions cannot legitimately impose additional Requirements. The Supremacy Clause of the U.S. Constitution makes this implicitly clear.

We’re preparing to take action. We are currently assessing different avenues to ensure that the Kansas application, already passed by a majority of legislators in both chambers, is counted toward the required 34 state applications to call a Convention of States.

Meanwhile, we are continuing to push forward in states like North Carolina, where we have already passed the House and are actively working towards a vote in the Senate, and in Iowa, where we have passed committees in both chambers and are pushing towards the next floor vote.
