Daily Docket — Tuesday, March 28

Here are some recent updates.

In this morning’s opinion release, the U.S. Supreme Court did not issue decisions in the two major voting rights cases, Moore v. Harper or Merrill v. Milligan. We’ll let you know when the next opinion day is scheduled.

Last night, the Georgia House passed a bill that would tighten and criminalize the state’s pre-existing ban on private funding in election administration, sending the bill to Gov. Brian Kemp (R). The ban on private funding was first enacted as part of the state’s 2021 omnibus voter suppression law Senate Bill 202. [link removed]

Last week, Virginia Gov. Glenn Youngkin (R) confirmed his plan to pause automatic voting rights restoration for people with felony convictions, breaking a decade-long precedent in the commonwealth and reverting Virginia to a 1902-era lifetime ban on voting for all individuals convicted of felonies. A few weeks ago, the 8th U.S. Circuit Court of Appeals paused proceedings in a lawsuit that challenges Arkansas laws limiting voter assistance. The case is paused until the court resolves another Arkansas case currently before the 8th Circuit. Parties in the latter case make the novel argument that there is no private right of action under a key provision of the Voting Rights Act, meaning that individuals and organizations cannot bring lawsuits under the law.
